Terms of Service

GovGopher is a service operated by VivianOps LLC, a Missouri limited liability company. These terms are the agreement between you and us. They are written in plain English on purpose — if anything here is unclear, email contact@vivianops.com and we will answer plainly. By creating an account or using the service, you accept these terms.

1. What GovGopher is — and what it isn't

GovGopher collects solicitation, bid and award information that government bodies have already published, organizes it, and summarizes it. It is a research and tracking tool.

GovGopher is an independent service and is not affiliated with or endorsed by SAM.gov, GSA, or any government agency. We have no special access, no inside information, and no role in any procurement. Nothing here is legal advice, bid-writing advice, or advice about whether to pursue any particular contract.

2. Your account

• You must be 18 or older and able to enter a contract.
• You are responsible for everything done under your account and for keeping your password secure. Two-factor authentication is available and we recommend turning it on. Tell us promptly if you believe your account has been accessed by someone else.
• An account belongs to one person. Team members get their own seats, up to the seat limit of your plan.
• Your company's private data — saved searches, pipeline, notes, uploads — is isolated to your company and is not shared with other customers.
• We may suspend or close an account for non-payment, for a breach of these terms, or where the law requires it. Where the circumstances allow, we will tell you why and give you a chance to fix it first.

3. Plans, billing and auto-renewal

• The Free plan costs nothing and does not require a payment method.
• Paid plans are sold as a subscription and are billed in advance — monthly or annually, whichever you choose at checkout.
• Your subscription renews automatically at the end of each billing period, at the then-current rate for your plan, using the payment method on file, until you cancel it. You are authorizing that recurring charge when you subscribe.
• Payments are processed by Stripe. Card details are entered on Stripe's hosted pages; we never receive or store your card number.
• Prices shown as "founding" rates are launch pricing. We may change our prices. If a change affects what you pay, we will give existing customers notice by email before it takes effect, and you can cancel before the next renewal if you don't want to continue at the new rate.
• Prices are exclusive of any taxes we are required to collect.
• Failed payments: we will retry and email you. If a payment stays unpaid past our grace period, paid features are suspended and the account reverts to the Free plan.

4. Cancelling

• You can cancel at any time yourself, from Settings → Plan & billing in the app. There is no phone call, no email required, and no retention process to sit through.
• Cancelling stops future renewals. Your paid access continues through the end of the billing period you have already paid for, and the account then reverts to the Free plan.
• We do not refund partial months or partial years. Cancelling mid-period does not generate a pro-rated refund.
• If we materially fail to deliver the service, contact us — we would rather sort it out directly than have you dispute a charge.

5. The 30-day trial

• New accounts get 30 days of the Pro feature set at no charge. No credit card is required to start, and we do not ask for one during the trial.
• Because no payment method is taken, the trial cannot convert into a charge. It does not auto-renew into a paid plan.
• When the 30 days are up, the account moves to the Free plan. Your data, saved work and pipeline stay where they are; the paid features lock until you choose to subscribe.
• One trial per customer. We may decline to grant repeat trials to the same person or business.

6. Acceptable use

You may use GovGopher to find and pursue government work for your own business. You may not:

• Scrape, crawl, bulk-download, or systematically extract the service or its contents by automated means, outside the export features we provide.
• Resell, republish, sublicense or redistribute our compiled data, our summaries, or any substantial part of the service, or use them to build or train a competing product or dataset.
• Share one account's credentials across people, or resell access.
• Use the service to break the law, to infringe anyone's rights, or in connection with any fraudulent or deceptive activity.
• Attempt to breach, probe or degrade the service, other customers' data, or the infrastructure it runs on. (Good-faith security research is welcome — write to us first at contact@vivianops.com.)

The underlying government records are public. Our selection, arrangement, enrichment and summaries of them are ours, and are licensed to you for your own business use only, for as long as your account is open.

7. Accuracy of the information — please verify before you bid

This section matters more than any other, so we will be blunt about it.

The information in GovGopher is aggregated automatically from public government sources and is provided "as is" and "as available". It may be incomplete, out of date, mis-parsed, or simply wrong. Agencies amend, withdraw, extend and re-post solicitations constantly, publish in formats that resist automated reading, and sometimes take sources offline without notice. Our AI-generated summaries are a convenience, not an authoritative restatement of any document.

Before you rely on anything here — and always before you bid — verify the details directly with the issuing agency, including the deadline, the scope, the requirements, any addenda, and the submission instructions. We link every opportunity back to its original source for exactly this reason. We do not warrant that any opportunity exists, is still open, is described accurately, or is suitable for your business, and we are not responsible for a missed deadline, a rejected bid, a lost contract, or any decision you make based on what you see here.

8. Availability

We work to keep the service up and the data fresh, but we do not offer a contractual uptime guarantee on self-serve plans. We may change, suspend or discontinue features, and we perform maintenance. Coverage varies by region and changes over time; we describe it honestly on our public pages and we will not claim coverage we do not have.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the service is provided without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the fullest extent permitted by law, VivianOps LLC will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost contracts, lost bids, lost business opportunities, or lost or corrupted data, even if we were advised such damages were possible.

Our total aggregate liability for any and all claims relating to the service is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim — and if you are on the Free plan, that amount is zero. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify and hold VivianOps LLC harmless from claims, losses and reasonable legal costs arising out of your use of the service, your content, or your breach of these terms.

11. Changes to these terms

We may update these terms. If a change is material, we will update this page and notify account holders by email before it takes effect. Continuing to use the service after that means you accept the revised terms. The "last updated" date at the top always reflects the current version.

12. Governing law and disputes

These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You and VivianOps LLC agree that any dispute arising out of or relating to the service or these terms will be brought exclusively in the state or federal courts located in Jackson County, Missouri, and both of us consent to the personal jurisdiction of those courts. If any provision of these terms is held unenforceable, the rest stays in effect.
